Birth through Heterologous Assisted Reproduction Techniques directly affects the children's parentage. According to the classical conception based on the law of biology, each son has a single mother and a single father; however, according to the law, this is not always the case, since based on the concept of filiation, one or both of them may be lacking. Accordingly, filiation is a condictio sine qua non that allows us to know the situation of the individual as the child of another, so as a consequence of this affirmation we can say that filiation involves a triple state: the first is the legal, arising from rule of law; the second is the social status with respect to others, and the third is the marital status, which is the legal status of the child in front of family members and society. The investigation is related to legal situations matched to the violation of the right to the identity of children born through heterologous assisted reproduction techniques; therefore, the instruments used are aimed at situations with the characteristics of children born through assisted reproduction techniques with donation of genetic material belonging to a third party, which are registered with a legal identity that do not match their biological identity, originating in both cases a violation of their right to identity as they have no access to know their true origin.
