Abstract: La presente tesis tiene por objeto explorar al arbitraje como una opción ante la excesiva demora en el Poder Judicial para obtener la restitución de inmuebles en el Perú en caso de incumplimiento de contrato, falta de pago, entre otros, y en este sentido, dar una mirada comparativa, descriptiva y crítica entre ambos fueros; esto es, el arbitral y el judicial. Para este efecto, nos enfocamos de manera especial en los centros de resolución de conflictos como es el caso del Centro de Arbitraje Popular Arbitra Perú, a fin de alcanzar un análisis del arbitraje institucional como mecanismo eficaz y a bajo costo para resolver controversias derivadas de contratos de arrendamiento, centrándonos en el caso específico de los desalojos. La presente investigación llega a la conclusión de que la alta carga procesal y la falta de previsibilidad, entre otros factores, dificultan la restitución de inmuebles y la solución de los conflictos derivados de los contratos de arrendamiento en el Perú; ante esta problemática proponemos la inclusión de una cláusula arbitral a todos los contratos de arrendamiento cuyas pretensiones no superen las (10) diez UIT, así como también la implementación de centros de arbitraje en cada sede municipal, los que estarán supervisados y monitoreados por Arbitra Perú. El tipo de investigación que se ha desarrollado es básica y cualitativa de diseño no experimental; para la recolección de datos se seleccionó y analizó diversos documentos de carácter jurídico y científico.
The present thesis aims to explore arbitration as an option in view of the excessive delay in the Judiciary to obtain the restitution of real estate in Peru in case of breach of contract, failure to pay, among others, and in this regard, give a comparative look, Both courts are descriptive and critical; that is, the arbitral and the judicial courts. For this purpose, we focus in particular on conflict resolution centers such as the Centro de Arbitraje Popular Arbitra Peru, in order to reach an analysis of institutional arbitration as an effective and low-cost mechanism for resolving disputes arising from leases, focusing on the specific case of evictions. The present investigation concludes that the high procedural burden and the lack of predictability, among other factors, make it difficult to restitution of real estate and the solution of conflicts derived from lease contracts in Peru; Faced with this problem, we propose the inclusion of an arbitration clause in all lease contracts whose claims do not exceed ten (10) UIT, as well as the implementation of arbitration centers in each municipal headquarters, which will be supervised and monitored by Arbitra Peru. . The type of research that has been developed is basic and qualitative with a non-experimental design; For data collection, various documents of a legal and scientific nature were selected and analyzed.
