Abstract: De la revisión de la demanda presentada se verifica que los señores
Jáuregui Vargas a su muerte dejaron en sucesión a sus cinco hijos
(Oscar Alejandro, Luz Orfilia, Nay Esperanza, Horacio y Napoleón
Jáuregui Vargas), el inmueble ubicado en el Jr. lima s/n de la Urb.
chicago alto, debidamente inscrita en la Partida Registral N° 03068007
de los registros públicos de la libertad la cual estaba valorizado en
S/70,000 Nuevos Soles. Los sucesores, acordaron dejar en posesión a
LUZ ORFILIA JÁUREGUI VARGAS, quien fallece al poco tiempo y el
inmueble quedo en posesión de su hijo ALBERTO RODRIGUEZ
JÁUREGUI, quién por desidia no ejecuto la sucesión de su madre, por
lo cual los sucesores solicitaron notificar a la sucesión intestada de LUZ
ORFILIA JÁUREGUI VARGAS y en caso no llegaban a un acuerdo
declarar la división y partición del inmueble, de ser necesario, el
remate del mismo.
En el siguiente caso, el Quinto Juzgado Civil falló declarando fundada
la demanda interpuesta de división y partición, ordenando que el
bien materia de Litis sea dividido y partido en forma proporcional, de
acuerdo a los porcentajes que les correspondía a favor de los
demandantes y codemandados.
From the review of the presented petition it is verified that the gentlemen Jáuregui Vargas to his death left in succession his five children (Oscar Alejandro, Luz Orfilia, Nay Esperanza, Horacio and Napoleon Jáuregui Vargas), the property located in the Jr. Lima s / n of the Urb. chicago alto, duly registered in Registry No. 03068007 of the public records of freedom which was valued in S / 70,000 Nuevos Soles. The successors, agreed to leave in possession LUZ ORFILIA JÁUREGUI VARGAS, who dies shortly after and the real estate was in the possession of his son ALBERTO RODRIGUEZ JÁUREGUI, who for lack of care did not execute the succession of his mother, which the successors requested to notify the intestate succession of LUZ ORFILIA JÁUREGUI VARGAS and in case they did not reach an agreement declare the division and partition of the property, if necessary, the auction of it. In the following case, the Fifth Civil Court ruled by declaring founded the interposed claim of division and partition, ordering that the well matter of Litis be divided and split proportionally, of according to the percentages that corresponded to them in favor of the plaintiffs and co-defendants.
