The research aims to : Demonstrate that by not allowing the intervention of legal persons in the preliminary hearing , its right of access to justice is affected, as well as the rights of defense and evidence, since the criminal procedure law introduces the figure of the legal person as a party to the proceedings ; meanwhile the Constitutional Court file No. 605 -2008 AA , acknowledged that the legal person may be fundamental rights holder as due process , effective judicial protection among others. The research is of type: Descriptive - explanatory, not experimental, it seeks to demonstrate that by not allowing the intervention of legal persons in preliminary proceedings access to justice and their rights of defense is breached and testing, affecting thus legal certainty and social peace, to propose solutions that can be presented to the competent authorities. For this reason, analytical, inductive, deductive and dogmatic methods used in research in order to properly use the data obtained on the study variables. For this investigation, the unit of analysis is determined by the preliminary proceedings in which legal persons are linked to the investigation as well as lawyers and specialists, all national in scope. The sample for the research will be taken from the data base to be obtained from the Public Prosecutor's Office (30 %). Similarly, in the case of the interviews and surveys, you will have to Criminal Judges and Prosecutors (total of 10), as well as specialists in the field (a total of 6), which gives us a high level of security analyzing the results .
