The present research work starts from the problem is the improper change of the binding precedent in the application of criminal principles by the Constitutional Court has caused inconsistencies in the judgments and lack of legal certainty? Having proposed to us as a research objective: to determine the main causes that determined the incongruous judgments on the criminal principles of the Constitutional Court as well as to establish the effects that contracted this improper modification of the binding precedents in the subsequent judgments, because it has been verified A tendency within the Constitutional Court to vary in a contradictory, incongruous or insufficiently motivated way some of its binding precedents, being determined that the factors that have influenced for this situation to occur would be the lack of consensus among the members of the Constitutional Court regarding Of the observance of its own binding precedents, as well as the lack of understanding and application of the rule of precedent change or technique of Overruling; To which is added the deficiencies in the argumentation of its failures, for this has been used the Scientific - Descriptive method, having obtained as a result that there is an improper change of the Binding Precedent as a cause of incongruity in the decisions of the Constitutional Court in matters of Criminal Principles.
