Problem: Is civil civil arrest in case of breach of maintenance duties constitutional? Objective: To explain if the civil civil arrest is constitutional in case of breach of food duties. Material and Method: A structured questionnaire was applied to a sample of 50 law professionals by variable, including Judges, Prosecutors and Lawyers. The design was non-experimental cross-sectional. Statistical analysis was used for statistical analysis. Results: If a citizen civil arrest is issued for delinquency in case of maintenance, it would not be harmful to the Political Constitution of the State, since it provides for imprisonment for debts in the event of a maintenance obligation. Conclusion: That the citizen civil arrest is constitutional and contributes to the procedural discharge which is beneficial for the administration of justice.
