The present investigation, is framed in a topic of great relevance, for our society, and even more because it has to do with the protection of children and adolescents, that is why the research will deal with “the parental alienation syndrome as element of assessment in the processes of psychological family violence”. The objective of this research is to propose that the parental alienation syndrome be considered as a form of family violence, in the modality of psychological violence, therefore its regulation in the Peruvian system. The method applied is legal descriptive and comparative because it is intended to generate solutions to a social legal problem, since the current regulations do not regulate the parental alienation syndrome as an element of assessment in the processes of psychological family violence. It can be evidenced that from January to August 2019 on the risk assessment for the integrity of the victim, there are a total of 116,913 cases attended, being that of the mild level they were 37,425 cases, at the moderate level 56,679 cases, and severe 22,809 cases attended., and in none of them, although parental alignment syndrome has been found, has it been taken as a type of violence.
