Abstract: La problemática del presente trabajo tiene origen en la formación de diversas formas de
familia que fueron apareciendo al pasar de los años, y que no se encuentran reglamentadas
en el ordenamiento legislativo Peruano, actualmente existe distintos tipos de familias porque
al ser un instituto natural se va acomodando a la realidad, además que evoluciona tanto el
hombre como la sociedad, generalmente para que esto suceda existen diversos factores que
generan este tipo de familias que podrían ser tanto por razones vinculadas al matrimonio,
el divorcio o la separación conyugal, la viudez que este motivo se da de forma natural, la
adopción, la unión de hecho, el surgimiento de movimientos liberales de la mujer, etc.
,Todas estas razones conllevan a un nuevo tipo de familia: monoparental, que es la
conformada por alguno de los progenitores y los hijos , al ser un tipo nuevo de familia carece
de seguridad jurídica en el ordenamiento jurídico siendo está muy común en el Perú y dentro
de nuestra legislación el estado resguarda la protección y la formación de la familia como
núcleo básico de la sociedad.
Sin embargo, existe algunos beneficios al que no se puede acceder a por motivos de forma
familiar, como solo existe un solo progenitor como cabeza de esta no se permite el acceso
a ellas, además en el ámbito social se ve como algunos establecimientos educativos sean
privadas y nacionales le niegan el acceso a la enseñanza porque no existe el vínculo
matrimonial mayormente este actuar se da en colegios religiosos.
Actualmente en la realidad se observa nuevos tipos de familia a consecuencia de los
diferentes cambios que ocurre dentro de la sociedad, por ejemplo, otro tipo de modelo familiar
seria la familia anaparental, la familia pluriparental, la familia ensamblada etc., Que estas al
igual que las familias monoparentales merecen un reconocimiento por el mismo hecho de
ser una familia, el estado resguarda la seguridad y protección dentro de la sociedad
cumpliendo con los derechos y deberes de una familia nuclear, en donde prevalezca el amor, la educación y la seguridad al niño basándose en principios básicos para poder desarrollarnos
de una manera correcta dentro de la sociedad sin embargo en el presente trabajo de
investigación se enfocó específicamente en las familias monoparentales ya es una realidad
muy cercana.
El objetivo principal del presente es el analizar si este tipo de familia ( monoparental), podría
tener un lugar dentro de nuestra legislación peruana, Un claro ejemplo de los novatos tipos
familiares como la familia ensamblada citada en la sentencia del tribunal constitucional
N°9332-2018 -PA es el caso de Don Armando Shols Pérez en donde se observa una
discriminación a la hija extramatrimonial, por el tipo de familia de la que provenía que era
una familia ensamblada , y como la menor no era su hija si no su hijastra no le querían
dar el pase de la NAVAL siendo también esta otro tipo familiar, demostrándose la falta
de regulación de los distintos tipos de familias que surgieron al transcurrir del tiempo,
al existir un reconocimiento de las familias ensambladas ,eso beneficia de manera eficiente
el desarrollo de otros tipos de familias , es una puerta que se abre la siguiente investigación.
En la presente investigación se citó distintos autores referidos al tema en especial que es la
familia monoparental, distintos artículos de investigación sobre el tema ya descrito, además
de un apoyo de trabajos de investigación tantos nacionales como internacionales, así como
convenios internacionales, el fin de estas es el amparo de la familia como foco de la sociedad,
esto con el fin de tener un desarrollo temático eficaz y que sirva de mucha ayuda para las
demás investigaciones.
Como problema principal en el actual trabajo es el de establecer cuáles son los
fundamentos facticos y jurídicos que van a permitir la regulación de este nuevo modelo
familiar en el código civil de 1984 para lo cual se utilizó un enfoque de investigación
Cualitativo y con un diseño de investigación no experimental. Llegando a la conclusión que si existen tanto razones jurídicas como fácticas que si
permitirían la regulación de la esta creación familiar en el código Civil de 1984 y para
efectuar con el objetivo de la presente se ha elaborado una propuesta legislativa para la
regulación de estas.
