Abstract: Esta investigación aborda la problemática vinculada a la protección del derecho
de acceso a medicamentos frente a las cadenas farmacéuticas en el Perú, en un contexto
en que la empresa Inretail Perú (Inkafarma) propietaria de las cadenas farmacéuticas
Inkafarma, Mifarma, BTL y Fasa, ostenta una posición predominante, concentra el 63%
de ventas frente al 37% correspondiente a otras cadenas farmacéuticas y boticas
independiente. El objetivo general de esta investigación fue estudiar la protección al
derecho de acceso a medicamentos frente a las cadenas farmacéuticas en el Perú. Se
empleó un enfoque de investigación cualitativo adecuado para investigaciones jurídicas.
El estudio es de tipo dogmático propositivo pues busca proponer soluciones para superar
las deficiencias identificadas en el ámbito de la legislación que regula la protección del
derecho de acceso a medicamentos. Un hallazgo significativo de este estudio, es que la
legislación nacional no interviene de la misma manera como se interviene en los países
estudiados sino que se realiza un control y una supervisión en un nivel más superficial a
través de la actividad de INDECOPI, además el Estado no asegura la debida distribución
de los medicamentos genéricos en todas sus presentaciones, por lo que en este último
caso, se requiere una modificación para lograr este objetivo de manera más eficiente y
beneficiosa para la población. Se concluye que el derecho de acceso a medicamentos está
en riesgo debido a prácticas comerciales inadecuadas por parte de las cadenas
farmacéuticas. Finalmente, se recomienda que las autoridades del Minsa y a los
miembros de la judicatura consideren los hallazgos de la presente investigación a fin de
impulsar mayores esfuerzos legislativos.
This research addresses the problem linked to the protection of the right of access to medicines against pharmaceutical chains in Peru, in a context in which the company Inretail Perú (Inkafarma), owner of the pharmaceutical chains Inkafarma, Mifarma, BTL and Fasa, holds a predominant position, it concentrates 63% of sales compared to the 37% corresponding to other pharmaceutical chains and independent pharmacies. The general objective of this research was to study the protection of the right of access to medicines against pharmaceutical chains in Peru. A qualitative research approach suitable for legal research was used. The study is of a propositional dogmatic type since it seeks to propose solutions to overcome the deficiencies identified in the field of legislation that regulates the protection of the right of access to medicines. A significant finding of this study is that national legislation does not intervene in the same way as it intervenes in the countries studied, but rather control and supervision is carried out at a more superficial level through the activity of INDECOPI, in addition to the State It does not ensure the proper distribution of generic medications in all their presentations, so in the latter case, a modification is required to achieve this objective in a more efficient and beneficial way for the population. It is concluded that the right of access to medicines is at risk due to inadequate commercial practices by pharmaceutical chains.
