The present work has as main theme the labor benefits violated to the workers hired under the modality of the Administrative Contract of Service in the Municipality of San Sebastian between the years 2016 and 2018, Despite the fact that these types of workers have a specific form, being that of private activity, as we will see later, there were workers who worked under an Administrative Service Contract. Since these hiring methods are different from one another, obviously the labor benefits would vary from case to case, even if these workers carry out the same activities in which they are hired according to the needs of the Municipality. Therefore, for the present investigation interviews were conducted with the staff of Human Resources and the Chief of Personnel of the Municipality of San Sebastian, in order to clarify some doubts as to why these employees were hired under this modality. A documentary analysis of the contracts used to employ these workers was also carried out, although there was already a separate system. Concluding with the discussion and comparison of the results obtained, to elaborate the respective conclusions and recommendations.
