The Labor Reposition constitutes one of the fields in which the Labor Law has undergone transformations, it is for them that it has generated protection mechanisms against any violation of the right to work. The right to reinstatement was created by the Constitutional Court in 2001 as a result of the interpretation they made of article 27 of the Constitution, which informs us that the Law grants the worker adequate protection against arbitrary dismissal. Thus, in the TC's opinion, the payment of compensation does not qualify as adequate protection, so it is necessary to open the possibility for the worker to choose between collecting the compensation money or requesting his return to the job. Replenishment is a legal mechanism by which an unfairly dismissed worker can re-enter his job through a court order.
