Aspecto jurídico del derecho al territorio de los pueblos indígenas en el departamento de Madre de Dios

Abstract

La presente investigación es la “EL ASPECTO JURÍDICO DEL DERECHO AL TERRITORIO DE LOS PUEBLOS INDÍGENAS EN EL DEPARTAMENTO DE MADRE DE DIOS” surge de la problemática jurídico social, de la litis existente entre pueblos indígena y nuestra Nación en relación al territorio que ellos ocupan dentro de un área determinada del departamento de Madre de Dios. En el primer capítulo de esta tesis desarrolla el problema de la investigación, el objetivo y la justificación de la tesis, los aspectos metodológicos del estudio que se aborda en la presente investigación; asimismo como la hipótesis de trabajo y categorías de estudio y los términos utilizados dentro de la investigación. En el segundo capítulo se divide sub capítulos como la base teórica, tratamiento jurídico y este se subdivide en capítulos que encierran la investigación con temas relacionados al bien jurídico protegido, la Constitución Política del Perú, el Convenio Internacional de Trabajo 169 OIT y las leyes que resguardan derechos a los pueblos indígenas, los otros sub capítulos son Las Naciones Unidas, Corte Internacional de Derechos Humanos y normas contrarias al derecho de territorio de los pueblos indígenas y concluimos con la hipótesis y la categoría es estudio de la investigación. La metodología para la investigación se encuentra en el tercer capítulo, es cualitativa y es dogmática socio – jurídica y está compuesta por el diseño metodológico de la investigación, unidad de estudio, técnicas e instrumentos de investigación. En el cuarto capítulo de la investigación encontramos el resultado y análisis del estudio entorno a los criterios del aspecto jurídico del derecho al territorio de los pueblos indígena del departamento de Madre de Dios, este análisis de los hallazgos, discusión y contrastación teórica de los hallazgos de la presente investigación concluye con las recomendaciones y conclusiones.

The present investigation is the “THE LEGAL ASPECT OF THE RIGHT TO THE TERRITORY OF INDIGENOUS PEOPLES IN THE DEPARTMENT OF MADRE DE DIOS“ arises from the social legal problem, from the existing dispute between indigenous peoples and our Nation in relation to the territory they occupy within of a certain area of the department of Madre de Dios. In the first chapter of this thesis he develops the problem of the investigation, the objective and the justification of the thesis, the methodological aspects of the study that is addressed in the present investigation; as well as the working hypothesis and study categories and the terms used within the research. In the second chapter the antecedents of the research that in this case we find national and international are addressed, later it is divided into sub chapters as the theoretical basis, legal treatment and this is subdivided into chapters that include research with topics related to the protected legal good, the Political Constitution of Peru, the International Labor Agreement 169 ILO and the laws that protect the rights of indigenous peoples, the other sub chapters are The United Nations, International Court of Human Rights and norms contrary to the land rights of indigenous peoples and we conclude with the hypothesis and the category it is study of the investigation. The methodology for the investigation is in the third chapter, it is qualitative and it is socio - legal dogmatic and it is made up of the methodological design of the investigation, unit of study, techniques and instruments of investigation. In the fourth chapter of the investigation we find the result and analysis of the study around the criteria of the legal aspect of the right to territory of the indigenous peoples of the department of Madre de Dios, this analysis of the findings, discussion and theoretical contrast of the findings of This investigation concludes with the recommendations and conclusions.
