Abstract: Que, durante la investigación acorde al artículo 829° del código civil peruano, tenemos que
señalar que es una vertiente que se estudia desde un punto donde los herederos tengan iguales
oportunidades para alcanzar su derecho; que el hecho de ser hijos extramatrimoniales
convivientes, no alcances a ese derecho que en nuestra investigación tratamos de abordar
para salvaguardarlos.
Es un artículo señalado 829° del Código Civil, el cual apunta como corresponde heredar los
hermanos de padre y madre con medios hermanos, los hermanos de padre y madre heredan
el doble que los medios hermanos, desde ese panorama podemos ver cuáles son las
implicancias y como se va ampliando con la perspectiva de la norma peruana y su
salvaguarda de esta.
La investigación diseñada nos hace más que introducirnos en un estudio y análisis dogmático
analítico dentro de la propuesta de investigación cualitativa, desde el estudio en cuestión,
sino sobre las leyes que giran sobre él, observando su propósito y presteza para la solución
el litis de intereses, y sobre todo su concordancia con los principios acumulados por nuestra
carta magna.
Lo que correspondería es entender y resolver la hipótesis planteado en nuestro estudio, ya
aludido primeramente “artículo 818 del Código Civil, el cual integra la igualdad de los
derechos sucesorios de los hijos, aunque sean estos matrimoniales o extramatrimoniales y lo
dispuesto por el artículo 822 del Código Civil, el cual señala que la cónyuge hereda igual
que un hijo. Por lo que en realidad correspondería dividir ese cincuenta por ciento entre los
nueve hijos y la cónyuge en partes iguales.” (Codigo Civil, 2022) Se recomienda a nuestros legisladores a formular propuestas legislativas que tomen en
cálculo de los derechos fundamentales inherente a los sucesores, que se hallan establecidas
en nuestra Constitución Política del Estado y Código Civil y que no se vulneren sus derechos.
Entendiendo que la legislación peruana tiene que evaluar las normativas con mayor
entendimiento de nuestra realidad, que si bien es cierto la existencia de los artículos en
nuestro código civil peruano, estos no están es esto de sus modificatorias.
That, during the investigation in relation to article 829 of the Peruvian civil code, we have to point out that it is an aspect that is studied from a point where the heirs have an equal opportunity to achieve their right and that the fact of being extramarital children, being cohabitants, do not reach that right that in our investigation sections of addressing to safeguard. It is a questioned article is the 829 of the Civil Code, which indicates that in case it corresponds to inherit siblings and there are siblings of father and mother with half siblings, the siblings of father and mother inherit twice as much as the half siblings, from that scenario we can see what the implications are and how it is expanding with the perspective of the Peruvian standard and its safeguarding of it. The outlined research does more than introduce us to a field of analytical dogmatic analysis within the qualitative research proposal, from the case in question, but on the rules that revolve around it, observing its purpose and application for the solution of the conflict of interest., and above all its consistency with the principles set forth in our Constitution. What should be taken into account to resolve the case raised is actually the aforementioned article 818 of the Civil Code, which tells us about the equality of succession rights of children, whether they are marital or extramarital, and the provisions of Article 822 of the Civil Code, which states that the spouse inherits the same as a child. Therefore, what would really correspond would be to divide that fifty percent between the nine children and the spouse in equal parts. It is recommended that our legislators and all those called to formulate legislative proposals taking into account fundamental rights, which is prescribed in our Political Constitution of the State, Civil Code, do not violate their rights. Understanding that the Peruvian legislation has to evaluate the regulations with a greater understanding of our reality, that although it is true the existence of the articles in our civil code, these are not in this of their modifications.
