El propósito del presente trabajo fue analizar las ventajas que ofrece el divorcio remedio frente al divorcio sanción en orden a promover una cultura de paz y conciliación familiar en el Perú, teniendo en cuenta que, en los procesos de divorcio por causal en nuestra legislación subsiste el tratamiento sancionador que genera un mayor deterioro de las relaciones familiares ya resquebrajadas, así como que un proceso judicial contradictorio no resguarda los intereses de la familia; el estudio es dogmático comparado en tanto se pretende analizar y contrastar dos enfoques respecto del Divorcio en relación a la Cultura de Paz y Conciliación familiar. Las principales conclusiones son: La situación de los procesos de divorcio en el Perú presenta una tendencia creciente sobre todo en los divorcios municipales y notariales que pertenecen al enfoque remedio; sobre los divorcios judiciales, tenemos que estos conflictos familiares se caracterizan por ser altamente complejos y densos, ya que en ellos intervienen no sólo las expectativas e intereses reconocidos por el ordenamiento procesal, sino también intensas emociones y sentimientos. En las alegaciones de las partes en litigio suelen ponerse de manifiesto las causas subyacentes del conflicto, como son, resentimiento, deseo de venganza y frustraciones. El conflicto oculto es un factor que exacerba el litigio y el enfrentamiento no termina con la resolución judicial; y, los resultados que viene presentando el Divorcio Remedio en el Derecho comparado, están basados en el respeto al principio de autonomía de la voluntad, como uno de los pilares de las relaciones familiares, sin dejar de lado al orden público y las buenas costumbres, considerándolo como el fundamento de la constitución del matrimonio y por ende también de su extinción; de tal manera que sus legislaciones prevén procesos de divorcios sin complicaciones, y cualquier cuestión derivada de la disolución del matrimonio se tramita en futuras acciones. La actual legislación peruana, conserva las causales de divorcio subjetivas tradicionales lo que no permite una comprensión del divorcio remedio pleno, siendo necesaria una implementación adecuada de este sistema. The purpose of this paper was to analyze the advantages offered by divorce remedy versus divorce sanction in order to promote a culture of peace and family reconciliation in Peru, taking into account that, in divorce proceedings for cause in our legislation there is still a sanctioning treatment that generates a greater deterioration of family relationships already broken, and that a contradictory judicial process does not protect the interests of the family; the study is comparative dogmatic in that it is intended to analyze and contrast two approaches to divorce in relation to the Culture of Peace and Family Reconciliation. The main conclusions are: The situation of divorce proceedings in Peru presents a growing trend especially in municipal and notarial divorces that belong to the remedial approach; about judicial divorces, we have that these family conflicts are characterized by their high density and complexity, due to the fact that what comes into play are not simply the expectations and interests that the judicial process admits, but strong emotions and feelings. With great frequency they appear in the disagreements that manifest the parts in the procedure, the motives that really impel to the confrontation: rancor, desire of revenge and frustrations. It is alluded to the concealed conflict as a determinant of the litigation and of the persistence of a situation of confrontation that does not end with the judicial resolution; and, the results that the Remedial Divorce has been presenting in the Comparative Law, are based on the respect to the principle of autonomy of the will as one of the pillars in the family relations in agreement with the public order and the good customs, considering it as the foundation of the constitution of the marriage and therefore also of its extinction; In such a way that simple divorce proceedings are contemplated and the incidents derived from the divorce are settled in subsequent proceedings, once the main issue, which is the dissolution of the marriage bond, has been resolved. The current Peruvian legislation preserves the traditional subjective grounds for divorce, which does not allow for an understanding of the full remedy divorce, being necessary an adequate implementation of this system.
