La tenencia compartida y su influencia en la defensa del interés superior de los niños y adolescentes en el distrito de Cusco - 2022

Abstract

La investigación tuvo como objetivo general analizar si la tenencia compartida garantiza la defensa del interés superior de los niños y adolescentes en el distrito de Cusco - 2022. Por ende, fue de diseño metodológico cualitativo, no experimental transversal, diseño contextual descriptivo – propositivo. Consigno como escenario espacio temporal el distrito de Cusco, en tanto las unidades de estudio fueron expedientes de sentencias en materia de tenencia (4) y especialistas en Derecho de Familia (4). Por tanto, las técnicas fueron el análisis documental y la entrevista, mientras que los instrumentos fueron la ficha de análisis documental y la guía de entrevista. El estudio concluye que la tenencia compartida garantiza la defensa del interés superior del niño y adolescente, porque se encuentra fundada en el Código del Niño y Adolescente, reglamentación que defiende los derechos del menor. Pero al no abarcar diferentes aspectos socio-emocionales no permite que el niño o adolescente se desarrolle en familia, mientras que esta se encarga de cubrir sus necesidades materiales, afectivas y psicológicas, de tal manera, que el menor presente bienestar integral.

The general objective of the research was to determine how shared tenure influences the defense of the best interests of children and adolescents in the district of Cusco - 2022. Therefore, it was of qualitative methodological design, not cross-sectional, descriptive contextual design – propositional. I consigned as a temporary space scenario the district of Cusco, while the study units were files of judgments in matters of tenure (4) and specialists in Family Law (4). Therefore, the techniques were documentary analysis and interview, while the instruments were the documentary analysis sheet and the interview guide. The study concludes that joint custody influences the defense of the best interests of children and adolescents, because it is based on the Code of Children and Adolescents, regulations that defend the rights of minors. If effective, it allows the child or adolescent to develop as a family, while this is responsible for covering their material, affective and psychological needs, in such a way that the child presents integral well- being.
