Factores sociales, económicos, culturales y jurídicos que conducen al adolescente a la infracción penal

Abstract

La presente investigación se realizó con el objetivo general de determinar el factor predominante que conduce al adolescente a la infracción penal en la ciudad de Sicuani, provincia de Canchis, región del Cusco, estudio que fue realizado en el primer semestre del año 2020 con la finalidad de conocer el factor más preponderante en la conducción del hecho ilícito por parte del adolescente. Los objetivos específicos están referidos a describir los factores sociales, determinar los factores económicos, identificar los factores culturales y el factor jurídico que conducen al adolescente a la infracción penal en la localidad de Sicuani recopilando información a través del análisis de la norma jurídica, la doctrina; aplicaremos una entrevista cerrada a diferentes especialistas en el tratamiento del menor infractor, utilizándose el método de la observación e interpretación de los resultados de la investigación. La investigación tiene un enfoque mixto cuali-cuantitativa, sé utilizó el método básico con diseño no experimental de alcance descriptivo. Llegándose a la conclusión que el factor predominante es de carácter social (entorno familiar y extra familiar) donde el adolescente está rodeado por diferentes situaciones que lo conduce a infringir la ley penal afectando la seguridad pública, la familia y al estado.

The present investigation was carried out with the general objective of determining the predominant factor that leads the adolescent to criminal offense in the city of Sicuani, Canchis province, Cusco region, a study that was carried out in the first half of 2020 with the aim of to know the most important factor in the adolescent's conduct of the wrongful act. The specific objectives are referred to describe the social factors, determine the economic factors, identify the cultural factors and the legal factor that lead the adolescent to a criminal offense in the town of Sicuani collecting information through the analysis of the legal norm, the doctrine and we will apply a closed interview to different specialists in the treatment of the minor offender, using the method of observation and interpretation of the results of the investigation. The research has a mixed qualitative-quantitative approach, using the basic method with a non-experimental design of descriptive scope. Reaching the conclusion that the predominant factor is of a social nature (family and extra-family environment) where the adolescent is surrounded by different situations that lead him to violate criminal law, affecting public safety, the family and the state.
