The Constitutional Court by the verdict in the file N° 3741-2004-AA/TC has implemented diffuse control in the administrative courts, with the intention of preserving the supremacy of the constitution, as well as the protection of the proccessed fundamental rights. However, subsequent to the verdict issued on merit of the file N° 4293-2012-AA/TC removes this valuable faculty power from the courts. From that moment, the administrative courts were unable to exercise diffuse control of constitutionality of the norms. Specifically the court to resolve appeals merely stated that it lacks the authority to exercise such control. So, far from issuing a ruling on the merits, it merely stated the appeals as inadmissible. Which indeed awares of the infringement of the rights of defense and due motivation. In this regard it is considered of vital importance to restore the ability to exercise diffuse control in administrative proceedings. It must be added that the court, for the period it held the diffuse control, played a significant role, because it allowed constitutional supremacy and to ensure respect of the fundamental rights mentioned above.
