In the field of the Violation of the Reasonable Period in the Preliminary Proceedings of the crimes of corruption of officials of the province of La Convencion of the department of Cusco during the year 2022, the objectives set are to establish logical and founded legal elements in relation to due process and its incipient intermittent reasonable period to monitor the preliminary diligence and its formalization of the preparatory investigation that exceeds its period with violation of fundamental rights that are protected by the Political Constitution of Peru and its other laws. For this reason, the current problem of the duration of the reasonable period arises, which has not been resolved to date by any competent body despite the existence of international jurisprudential guides that recommend its application in its judicial bodies. Likewise, we emphasize the time that exists in today's society, such as the work regime that requires an entry and exit time with production at work and its different restrictive measures that are applied when it is not possible to feel satisfied. As mentioned above and unlike due judicial process with its deadlines provided for in criminal law, this is violated when it is exceeded and there is no response in relation to the person responsible for the investigation and reparation of the damage caused to the injured party. That is why this investigation delves into the complex period of the previous investigation, to alternate other effective and/or simple measures that do not cause harm to those investigated and the state government. In this sense, break the barrier of no time to which many doctrinaires adhere; It is recurrent and mandatory to apply binding precedents from the jurisprudence of international courts in relation to the violation of the reasonable time. On the other hand, reinforce the above in accordance with existing international standards that protect the correct functioning of an investigation with the knowledge of each State Party, to apply before the national judicial body of Peru.
