The general objective of this research was to determine whether the restriction of the evidentiary activity violates the due process in court, in administrative litigation proceedings from the Municipality of Wanchaq, in the period from 2016 to 2022, it was postulated as a general hypothesis that; the restriction of the evidentiary activity violates the due process in court, in administrative litigation proceedings from the Municipality of Wanchaq, in the period from 2016 to 2022, in an ineffective manner. The research was qualitative of Legal Analytical type , the data collection techniques were: analysis of specialized texts, scientific articles, research and physical and virtual academic material, as well as analysis of files , the hypotheses were validated and the main conclusion corroborates the general hypothesis in the following sense it was evidenced that the restriction of evidentiary activity effectively violates the due process in judicial venue, restricting to the administered the right to effective jurisdictional protection and defense. The fundamental recommendation is that our legal system should watch over the due process in a textual manner, admitting the presentation of evidence within the administrative litigation process.
