Abstract: A medida que nuestra sociedad asume instituciones jurídicas nuevas en razón de la
tecnología, se encuentran obviamente sin legislar es el caso de la maternidad subrogada y la
igualdad de los derechos reproductivos del hombre y de la mujer en igualdad de derechos tal
como establece nuestra constitución de 1,993, en el artículo segundo numeral 2 que nos
expresa: A la igualdad ante la ley. Nadie debe ser discriminado por motivo de origen, raza,
sexo, idioma, religión, opinión, condición económica o de cualquiera otra índole. Por ende, se
puede entender haciendo una interpretación solamente gramatical, que la igualdad recae tanto
en hombres como mujeres. La maternidad subrogada surge como una solución por lo menos
momentánea, de la cual podemos determinar preliminarmente que debemos corregir en nuestra
legislación ese vacío, que las personas sienten al momento de formar una familia (sea esta de
tipo monoparental), este material de investigación tratará de dar una alternativa en cuanto a la
solución, quizás temporal (digo esto, porque definitivamente la humanidad seguramente
cambiara o inventara nuevas formas de lograr la igualdad en los derechos reproductivos),
asimismo hemos visto por conveniente proponer en esta investigación el contrato subrogado,
como parte de una solución, que pueda dar lucidez y entendimiento entre las partes que
intervienen en un contrato de vientre subrogado, este comprenderá las diversas formas de
contratar, y a su vez introducir clausulas obligatorias como por ejemplo la entrega del nacido,
fecha y condiciones, así como el costo en dinero y las diversas condiciones de las partes
plasmen en dicho contrato, por consiguiente esta investigación si tiene un asidero jurídico como
social, esperando que se tenga un resultado real y que sea un aporte a la sociedad peruano en
cuanto a la igualdad de los derechos reproductivos entre el hombre y mujer.
As our society assumes new legal institutions due to technology, they are obviously without legislating, in the case of surrogate motherhood and the equality of reproductive rights of men and women in equal rights as established in our constitution of 1,993, in the second article numeral 2 that expresses us: To equality before the law. No one should be discriminated against for reasons of origin, race, sex, language, religion, opinion, economic condition or any other nature. Therefore, it can be understood by making a purely grammatical interpretation, that equality falls on both men and women. Surrogate motherhood emerges as a solution, at least momentarily, from which we can preliminarily determine that we must correct this gap in our legislation, that people feel when starting a family (whether it is single-parent), this research material will deal with to give an alternative in terms of the solution, perhaps temporary (I say this, because humanity will definitely change or invent new ways to achieve equality in reproductive rights), we have also seen it as convenient to propose in this investigation the surrogate contract, as part of a solution, which can provide lucidity and understanding between the parties involved in a surrogate mother contract, this will include the various forms of contracting, and in turn introduce mandatory clauses such as the delivery of the born, date and conditions, as well such as the cost in money and the various conditions of the parties reflected in said contract, therefore this investigation does have a legal and social basis, hoping that it will have a real result and that it will be a contribution to Peruvian society in terms of equality of reproductive rights between men and women.
