The present investigation was born as a result of the inequality that is produced by the special provisional reinstatement measure regulated in article 55 of the New Labor Procedure Law, which gives priority to some cases of null dismissal, but not to all. In this sense, the objective of this investigation has been to describe how the inequality of the special measure of labor replacement affects labor law in the precautionary process. Well, we know that every worker who is fired for any illegal reason deserves due protection because constitutional rights such as the right to work are at stake, in addition to due process and the nature of the labor process itself, which is to protect the worker for being the weaker part of the employment relationship; without counting on the rights that derive from the right to work. For this reason, the present investigation has a methodology that is approached with a qualitative approach, assuming the legal dogmatic type. Therefore, as a result, after describing how the inequality of the special provisional reinstatement measure affects the precautionary process, and it is concluded that it negatively affects the labor rights of those illegally dismissed workers who are not present. under the conditions established in article 55 of the TUO of the New Labor Procedure Law; making said precautionary measure a benefit only for a specific vulnerable group.
