Abstract: La investigación titulada “EL ORIGEN DEL NEOCONSTITUCIONALISMO EN AMÉRICA
LATINA: LA CONSTITUCIÓN PERUANA DE 1979”, tuvo como objetivo determinar el origen
del neoconstitucionalismo en América Latina. Metodológicamente sigue una ruta cualitativa, tipo
de investigación básica, teórica o pura, diseño de estudio no experimental y alcance exploratorio.
La técnica e instrumento de recolección de datos, fueron el análisis documental y la ficha
referencial, respectivamente. Como resultado de la investigación, es preciso mencionar que
durante la década de los 70 y 80, América Latina estuvo marcada por dictaduras militares. Se
mostraba un clima adverso a la Constitución y los derechos fundamentales, generándose graves
crisis, violencia política y violaciones a derechos humanos. Motivo por el cual los Estados
Latinoamericanos empezaron a desarrollar instrumentos internacionales de protección de
Derechos Humanos, firmándose así la Convención Interamericana de Derechos Humanos en 1969.
En ese contexto - en el Perú - los militares anuncian una transferencia de poder a los civiles en
1980, convocándose previamente a una Asamblea Constituyente que, conforme al planteamiento
gubernamental, debía constitucionalizar las reformas realizadas por el gobierno. Por la forma como
estuvo compuesta y al ser una transición para el retorno a la democracia, hizo que su producto, la
Constitución de 1979, sea la única Constitución en la historia del Perú que no se da con el fin de
legitimar a un caudillo de turno o tratar de dar legitimidad a alguna ruptura democrática. La única
constitución con una legitimidad de origen indiscutido por lo que podría decirse que fue la única
constitución democrática del Perú. Es por ello también su excepcionalidad y gran legitimidad. Se
concluyó que al ser la Constitución de 1979 aquella con contenido material y tener el inicio de una
práctica jurisprudencial en defensa de la Constitución, es con esta Carta Magna con la que se da
inicio al neoconstitucionalismo en América Latina, no siendo Colombia ni Brasil – como muchas
veces se ha afirmado – ya que estas constituciones tuvieron esas características posteriormente.
The investigation titled “THE ORIGIN OF NEOCONSTITUTIONALISM IN LATINA AMÉRICA: THE PERUAN CONSTITUTION OF 1979”, was intended to determine the origin of neoconstitutionalism in Latin America. Methodologically it follows a qualitative route, such as basic, theoretical or pure investigation, non-experimental study design and exploratory potential. The technique and instrument of data collection were documentary analysis and reference data, respectively. As a result of the investigation, it is precise to mention that during the decades of the 1970s and 1980s, Latin America was marked by military dictatorships. It showed a climate adverse to the Constitution and fundamental rights, generating serious crises, political violence and violations of human rights. For this reason, Latin American states began to develop international instruments for the protection of human rights, thus signing the Inter-American Convention on Human Rights in 1969. In this context - in Peru - the military announced a transfer of power to civilians in 1980, by previously convening a Constituent Assembly which, in accordance with the gubernamental plan, must constitucionalizar the reforms implemented by the government. In its current form and it will be a transition to the return to democracy, I know that its product, the 1979 Constitution, is the only Constitution in the history of Peru that is not intended to legitimize a leader of Peru turn or try to give legitimacy to some democratic rupture. The only constitution with an undisputed legitimacy of origin is why it could be decided that it was the only democratic constitution of Peru. It is also due to its exceptionality and great legitimacy. It was concluded that at the time of the 1979 Constitution the one with material content to mark the beginning of a jurisprudencial practice in defense of the Constitution, it is with this Carta Magna with which the beginning of neoconstitutionalism in Latin America, not being Colombia or Brazil - as it has been affirmed many times - that these constitutions will reveal these characteristics subsequently.
