The purpose of this research was to be able to show and demonstrate that national and international gaps continue to exist in order to access a quality, equitable education, respecting the differences between students; Considering that the essential problem is aimed at answering, How has the protection of the right to an inclusive education for people with different abilities been applied in Peru? Considering it necessary to be able to make a specific analysis of areas such as education, people with different abilities, regulations that support this fundamental right. This work followed the path of a socio-legal investigation, taking into account that it is a subject of social and legal analysis, observing our current reality, reaching specific and important conclusions to be addressed such as The guardianship, application, execution and respect of inclusive education In our country, it is affected and deteriorated, at the national level a large number of people have a disability, which limits access to different activities, this has prompted regulatory changes, but the vast majority still do not have equal access a education, since integrating all students, enhancing their capacities and abilities turns out to be more complex, learning and receiving quality education together with the practice of values such as respect, equality and integration, continues to be a point of analysis and debate that should be cared for and prioritized as the intervening children who wish to be part of a society accessing education as a fun right fundamental.
