The present investigation work tries to determine if the principle of opportunity is effective in some crimes of criminal matter, to be more exact about crime of common danger in its modality of driving while intoxicated in the city of Quillabamba. While it is true with the introduction of the principle of opportunity, it is intended to innovate and speed up some crimes; thus enabling the prompt culmination of the criminal process. Thus, the principle of opportunity is constituted within the Peruvian procedural system as a form of solution and mitigation of the penalty to be imposed in crimes of common danger, in this case we will talk about drunk driving who violates this rule enjoy This mechanism of early termination deserving an administrative sanction such as the suspension of your brief. In the city of Quillabamba, the offenders immersed in the crime of Common Danger- Driving In the State of Drunkenness are increasing every year, it is necessary to make known that this crime is considered by the Public Ministry (First and Second Corporate Criminal Provincial Prosecutor of the Convention - Quillabamba), as the second most committed crime in this city, because we see that it is not fulfilling the persuasive function in society; On the contrary, it has apparently been taken as an immediate mechanism to get out of the individual problem of the transgressor, as a way of avoiding the danger posed by an individual, while driving a vehicle while drunk, there are also cases in which the transgressor , after having been arrested while driving while intoxicated, he is subjected to ethyl dosing and to give his statement, once released from the commissioner, the transgressor does not appear at the Prosecutor's Office and learns that he is under arrest warrant. .
