Oposición al Procedimiento de Inscripción Registral en Trámite y los Supuestos de Cancelación del Asiento Registral Regulados en la Ley N° 30313 Propuesta para la modificación legislativa.

Abstract

La presente investigación se realiza mediante el Enfoque cualitativo realizando el análisis de argumentos doctrinarios y de documentos, con la aplicación de la argumentación jurídica, siendo un tipo de investigación jurídica dogmática propositiva con la que se pretende establecer las razones suficientes para elaborar una propuesta legislativa de modificación de los procedimientos de la oposición al procedimiento de inscripción registral en trámite y cancelación del asiento registral por suplantación de identidad o falsificación de documentación por regulados en la Ley N° 30313 para el fortalecimiento de la seguridad jurídica, ya que como se ha podido advertir, que desde la dación de esta norma los procedimientos no han aportado de manera eficaz para el fortalecimiento de la seguridad jurídica en el sistema registral peruano. Se tiene como hipótesis que el procedimiento es complicado y complejo. Teniendo como objetivo determinar cuál es la orientación doctrinaria que se usó para la dación de la Ley Nº 30313 que regula de estos procedimientos, como operan estos en la realidad, cuales son los factores que dificultan su aplicación correcta y al identificar los anteriores problemas, se podrá proponer una modificación para una correcta y eficaz aplicación de estos procedimientos. Finalmente, otro aspecto importante a destacar, es que con la presente investigación, también se pueda reconocer las fortalezas que tiene el procedimiento oposición al procedimiento de inscripción registral en trámite y cancelación del asiento registral por suplantación de identidad o falsificación de documentación por regulados en la Ley N°30313, por lo que con la investigación se lo que se pretende dar estudio y aportar en la modificación de algunos aspectos que se considera que no ayudan a la eficacia y además no aporta a la seguridad jurídica como lo pretendía el legislador.

The present investigation is carried out through the qualitative approach making the analysis of doctrinal arguments and documents, with the application of legal argumentation, being a kind of proactive dogmatic legal research with which it is intended to establish sufficient reasons to elaborate a legislative proposal of modification of the procedures of the opposition to the registration procedure in process and cancellation of the registration seat due to identity theft or falsification of documentation regulated by Law N ° 30313 for the strengthening of legal security, since as has been noted , that from the dación of this norm the procedures have not contributed of effective way for the fortification of the legal security in the Peruvian registry system. It is hypothesized that the procedure is complicated and complex, with the objective of determining what doctrinal orientation was used for the enactment of Law No. 30313 that regulates these procedures, how they operate in reality, what are the factors that hinder their correct application and by identifying the previous problems, a modification may be proposed for a correct and effective application of these procedures. Finally, another important aspect to be highlighted is that with the present investigation, one can also recognize the strengths of the procedure opposed to the registration procedure in process and cancellation of the registration seat due to identity theft or falsification of documentation regulated in the Law No. 30313, so that the investigation is what is intended to give study and contribute to the modification of some aspects that are considered not to help effectiveness and also does not contribute to legal security as the legislator intended.
