Abstract: Al hablar del proceso civil de divorcio en el Perú, hablamos de un proceso que se
encuentra en el derecho de familia, es trascendental hacer mención de lo que indica el Tercer
Pleno Casatorio Civil: La doctrina procesal contemporánea ya ha destacado la gran importancia
que tiene la estrecha relación entre el proceso y el derecho material, por esta razón se postula el
carácter instrumental del derecho procesal respecto del derecho material. En este contexto es
ineludible concluir que el derecho material influye y muchas veces condiciona al legislador para
establecer determinada estructura a cada tipo de proceso; así mismo, la naturaleza de la situación
material y del conflicto de intereses que nace de éste, influye de diversa manera en el
comportamiento de los sujetos procesales, particularmente en el Juez. (…)
En consecuencia, la naturaleza del derecho material de familia, en sus diversas áreas y en
distintos grados, condiciona al legislador y al Juez para regular y desarrollar procesos que
correspondan a aquella naturaleza, evitando el exceso de ritual y la ineficacia del instrumento
procesal. Se comprende por ello que, por un lado, el proceso tenga una estructura con
componentes flexibles y, por otro lado, el Juez de familia tenga amplias facultades tuitivas.
La inaplicación de la función tuitiva de los jueces en los procesos de divorcios remedio ,
resultan en una demora del proceso y con ello en la vulneración de derechos del tutelado como lo
son la libertad , la dignidad y el libre desarrollo , además que no se prepondera el interés superior
del niño y adolescente. Es necesario establecer que a pesar de que los jueces cumplen con aplicar
la ley , frecuentemente se dan casos en los que es necesario ir más allá de una aplicación estricta
ya que se debe preponderar otros aspectos de los casos en concreto por ejemplo , los derechos de
dignidad , libertad y libre desarrollo, esto debido a que en los casos de divorcio remedio se pone
en riesgo estos, porque hablando respecto a casos de divorcio, se involucran temas emocionales e
interacción humana entre los involucrados (cónyuges, hijos y familia colateral en general) , dado
a esto se debe tener en cuenta que esta situación afectará directamente al interés superior del niño
y adolescente.
