The purpose of this research is to establish the differences that exist on the right to access to the Internet, as a fourth generation human right in comparative legislation, the need for constitutionalization in Peru, analyze the legal, economic and social implications; It addresses all the legal bases relating to the right that a person has to access the Internet, as a fundamental right. The research has a qualitative approach, dogmatic comparative, socio- legal and the research design is grounded theory. The technique of documentary analysis and interview was used, as instruments, the documentary and bibliographic analysis sheet, structured interview guide, respectively. It has been concluded that the right to access the Internet was established in some European and Latin American states, through the constitution, others, by jurisprudence, others through laws, differences were found regarding the use of the Internet in each country, Establishing rural areas that are most affected to enjoy this universal right, whether due to connectivity, geography or lack of interest on the part of authorities to expand their coverage; Likewise, there are sufficient legal foundations for constitutionalization in Peru; Recognition as a fundamental right in our country is very positive, since it brings multiple benefits in all aspects of human life and the Peruvian state must establish norms that regulate good use, restrictions, provide an adequate budget for the implementation and guarantees free Internet accessibility.
