Abstract: Es el caso de Ley N° 30710, vigente desde el 29 de diciembre del año 2017, que
modifica el artículo 57° del Código Penal, ampliando la prohibición del beneficio de
suspensión de la pena efectiva a los condenados por lesiones leves causadas por violencia
contra la mujer, donde a la letra establece la suspensión de la ejecución de la pena es
inaplicable a las personas condenadas por el delito de agresiones en contra de la mujer o
integrantes del grupo familiar del artículo 122-B del Código Penal. En tal sentido al ser una
modificatoria reciente los jueces siguen ciertos protocolos procesales y técnicas legales que
no están regulados en la norma expresamente, por lo que la presente investigación pretende
describir lo concerniente al delito regulado el art. 122-B del Código Penal sobre agresiones
en contra de las mujeres o integrantes del grupo familiar, en cuanto a la aplicación de pena,
alcances, sujeto activo y pasivo del delito y características generales. La problemática surge
en la determinación no solo de la tasa de la comisión de delitos a la fecha, sino en el
tratamiento jurídico, el protocolo legal, el tiempo de duración, la protección a las víctimas,
la aplicación de la pena que determina la fiscalía y aceptan los jueces, la cual también es
refutada por los abogados defensores por la comisión del delito regulado en el 122-B del
Código Penal.

The problem arises in the determination not only of the rate of the commission of crimes to date, but in the legal treatment, the legal protocol, the duration, the protection of the victims, the application of the penalty determined by the prosecution and the judges accept, which is also refuted by the defense lawyers for the commission of the crime regulated in 122-B of the Criminal Code.
