El delito de trata de personas con fines de explotación sexual y vulneración a los derechos humanos de adolescentes mujeres en la ciudad de Quillabamba, durante el año 2019

Abstract

Los objetivos específicos están referidos a indagar cuáles son los principales derechos humanos vulnerados a las adolescentes mujeres e indagar cuáles son las causas y factores que influyen en el delito de trata de personas con fines de explotación sexual en la ciudad de Quillabamba, durante el año 2019. Se postuló como hipótesis: “Los derechos humanos de adolescentes mujeres son vulnerados severamente por el delito de trata de personas con fines de explotación sexual en la ciudad de Quillabamba, durante el año 2019 por parte de la sociedad y el estado, respecto a los siguientes derechos: derecho a la libertad personal, derecho a la libertad sexual, derecho a la indemnidad sexual, derecho a la salud física y mental, derecho a la libre elección de trabajo, derecho a la educación, derecho a la tutela judicial efectiva, con esta pluralidad de vulneración de derechos se afecta gravemente a la dignidad humana”. Dentro del marco teórico se desarrolló y analizó la teoría pertinente al delito de trata de personas con fines de explotación sexual, los Derechos humanos, Normativas que reconocen a los derechos humanos. La investigación fue cualitativa documental, la discusión de los resultados se realizó a través de la argumentación jurídica basados a los datos facticos y teóricos. La hipótesis fue validada, y la principal conclusión fue: “Los derechos humanos de adolescentes mujeres son vulnerados severamente por el delito de trata de personas con fines de explotación sexual en la ciudad de Quillabamba, durante el año 2019, por parte de la sociedad y el estado respecto a los siguientes derechos: derecho a la libertad personal, derecho a la libertad sexual, derecho a la indemnidad sexual, derecho a la salud física y mental, derecho a la libre elección de trabajo, derecho a la educación, derecho a la tutela judicial efectiva, con esta pluralidad de vulneración de derechos se afecta gravemente a la dignidad humana”. La recomendación fundamental está dirigida al Estado, mediante sus instituciones administradores de justicia como son: la Policía Nacional, el Ministerio Público, el Poder Judicial, tienen el deber de; detectar, mediante constantes operativos, investigar rigurosamente y sancionar de manera eficaz este delito que daña a nuestras adolescentes mujeres.

The general objective of this study was to analyze how the human rights of adolescent women are violated by the crime of trafficking in persons for the purpose of sexual exploitation in the city of Quillabamba, during the year 2019. Within the theoretical framework, the theory relevant to the crime of trafficking in persons for the purpose of sexual exploitation, Human Rights, Regulations that recognize human rights, was developed and analyzed. The research was qualitative documentary, the discussion of the results was carried out through legal argumentation based on factual and theoretical data. The hypothesis was validated, and the main conclusion was: "The human rights of female adolescents are severely violated by the crime of trafficking in persons for the purpose of sexual exploitation in the city of Quillabamba, during the year 2019, by society and the state with respect to the following rights: right to personal freedom, right to sexual freedom, right to sexual indemnity, right to physical and mental health, right to free job choice, right to education, right to effective judicial protection, with this plurality of violation of rights, human dignity is seriously affected”. The fundamental recommendation is addressed to the State, through its justice administration institutions such as: the National Police, the Public Ministry, the Judicial Power, have the duty to; detect, through constant operations, rigorously investigate and effectively punish this crime that harms our adolescent women.
