The identity of the people is certainly a right that is considered fundamental in many legislations, in Peru this right is consigned in article 2 of our Constitution. This study has as objective to analyze the treatment of dynamic identity in filiation processes in Peru and how the mentioned treatment safeguards the principle of the best interest of the child. The study is of exploratory dogmatic nature and for this purpose the normative framework and the jurisprudential treatment were analyzed, especially the constitutional one, determining that there is a firm position among the magistrates to recognize the dynamic identity when it comes to preserving the best interests of the child who he has acquired an experiential identification with the non- biological family and in the event of his being uprooted for wanting to make the biological identity prevail, it would seriously affect the emotional and experiential development of the child. The position assumed by sorne countries in their respective legal and jurisprudential framework has also been analyzed, concluding that the defense of dynamic identity prevails when it comes to safeguarding the best interests of the child, culminating in a legislative proposal to modify the article 363 of the Civil Code.
