Abstract: La investigación desarrollada versa sobre la problemática de la participación en los procesos
electorales de los procesados internos en un centro penitenciario como consecuencia de la
aplicación de una medida de coerción personal – prisión preventiva- que se aplica con la
finalidad de asegurar la comparecencia de manera presencial al proceso penal que se
desarrolla en su contra, sin embargo, en la resolución que dispone su internamiento en un
centro penitenciario de manera preventiva no se hace mención alguna sobre realizar o
efectivizar el derecho al sufragio.
Esta investigación tuvo el objetivo de la búsqueda de fundamentos que impidan el ejercicio
del derecho al sufragio de los procesados internados en un centro penitenciario como
consecuencia de la aplicación de una medida de coerción personal – prisión preventiva-
dictada en su contra. Además de la búsqueda de una alternativa para que puedan ejercer su
derecho al sufragio.
The research developed focused on the problem of participation in the electoral processes of internal processes in a penitentiary center as a consequence of the application of a measure of personal coercion - preventive detention - that is applied with the purpose of ensuring the appearance of a person to the criminal process that is being carried out against him, however, in the resolution that provides for his preventive internment in a penitentiary center, no mention is made of realizing or making effective the right to vote. The objective of this investigation was to search for grounds that would prevent the exercise of the right to vote of the defendants who are interned in a penitentiary center as a consequence of the application of a measure of personal coercion -preventive detention- dictated against them. In addition to the search for an alternative so that they may exercise their right to vote.
