The general objective of this research was to determine how the situation of children with visiting arrangements in the context of the COVID 19 pandemic should be resolved, taking into account the health measures issued and the Principle of the Best Interest of the Child. The hypothesis formulated was, the situation of children with visitation regimes in the context of the COVID 19 pandemic, taking into account the health measures issued and the Principle of the Best Interest of the Child, should have been solved through a weighing of rights. The research was qualitative, of legal dogmatic type, the categories of study analyzed, the principle of the Best Interest of the Child and the Visitation Regime; the data collection techniques were documentary analysis and interviews, the discussion of the results was carried out through legal argumentation. The hypotheses were validated, and the main conclusion was, the situation of children with visitation regimes in the context of the COVID 19 pandemic, taking into account the sanitary measures issued and the Principle of the Best Interest of the Child, should be solved through a weighing of rights, guaranteeing the direct contact of the child with the parent subject to the visitation regime, analyzing the particular situation of each case individually, the main recommendation is directed to the Executive Branch in the sense of designing public policies to face a risk situation of similar magnitude to the COVID 19 pandemic, with the purpose of safeguarding the fundamental rights of minors, especially the right to maintain contact with the parent with whom he/she does not reside.
