Abstract: Principalmente la minería se desarrolla en la provincia de Tambopata esta ha ido
aumentando de forma creciente por el precio del metal, esto conlleva a migrar personas
de todos los Departamentos con el único fin de trabajar en la minería y a causa de esto
en nuestra amazonia actualmente ha provocado serios impactos en el ecosistema, debido
a la contaminación de mercurio el cual es usado por los mineros y otros desechos que
contaminan el agua a los que consumimos el agua. Otra problemática a causa de la
minería es la deforestación masiva.
El presente trabajo de investigación trata de los conflictos sociales de superposición
relacionados con las actividades extractivas la minería por su parte el estado al otorgar
derechos de extracción de minerales del subsuelo condiciona una serie de requisitos por
ejemplo los estudios de impacto ambiental estos van tener un impacto necesario en el
propietario u ocupante del suelo que no fue informado.
Nos enfocamos en la provincia de Tambopata, el presente Trabajo trata del conflicto
que existe entre la superposición de concesiones mineras dentro del territorio,
derechos de uso de tierra se superponen a la Agricultura, Minería, Concesiones
Forestales maderables, no maderables, CCNN, y otros y estarían afectando la
sostenibilidad de los recursos.
Existen 26 concesiones tituladas y 43 en trámite en la Reserva Nacional Tambopata y 1
concesión titulada y 15 concesiones en trámite en la Reserva Comunal Amarakaeri. El
Sector de Energía y Minas, a través de INGEMMET y Minas e Hidrocarburos
(DREMH) han otorgado miles de derechos mineros, sin tomar en consideración los
derechos adquiridos y que se sobreponen a tierras de personas naturales comunidades
nativas a concesiones para ecoturismo a áreas naturales protegidas, a propiedades
agrícolas concesiones forestales y concesiones para reforestación.
