El principio de predictibilidad judicial y la implementación de la sub especialidad de juzgados comerciales en el distrito judicial del Cusco.

Abstract

El principal objetivo del presente trabajo de Investigación es la Implementación de la Sub Especialidad Comercial en el Distrito Judicial del Cusco, para que de esta forma se cumpla el Principio de Predictibilidad garantizando la Eficacia Jurídica, ya que los Operadores Judiciales se encontraran debidamente capacitados para emitir decisiones idóneas en materia de Proceso Único de Ejecución. En la actualidad existen 5 Juzgados Civiles dentro de las cuales se generan con mucha frecuencia resoluciones judiciales inadecuadas las que afectan y vulneran el Debido Proceso, así como también atenta en contra el principio de Economía y Celeridad Procesal en materia de Proceso Único de Ejecución. Dicha investigación se desarrolló de la siguiente forma: Las bases teóricas se dividieron en tres partes la primera que nos refiere a la Ejecución Judicial, nociones básicas. La segunda parte sobre el desarrollo Proceso Único de Ejecución (Obligación de dar suma de dinero) y la última parte sobre Jurisdicción Comercial en el Perú. Se profundizo y demostró con datos verificables la existencia del problema que motivo la presente investigación. Por último, se denoto que es necesaria la Implementación de la Sub Especialidad Comercial en el Distrito Judicial del Cusco.

The main objective of this research work aimed at the implementation of the Sub Specialty in the Judicial District of Cusco, so that compliance with the principle of predictability by ensuring the effectiveness of legal judgment, because judicial operators are properly trained to issue decisions best practices in unique process of implementation. There are currently 5 Civil Courts within which they generate very often inadequate judicial resolutions that affect and violate the due process as well as vigilant against the principle of economy and celerity in the field of unique process of implementation. This research was developed in the following way: The theoretical bases were divided into three parts, the first refers to the judicial execution, basic notions. The second part on the unique process of implementation (obligation to sum of money) and the last part on Trade Jurisdiction in Peru. Deepened with verifiable data and demonstrated the existence of the problem that motivated the present investigation. Finally, it is necessary that the implementation of the Sub Specialty in the Judicial District of Cusco.
