Abstract: Ser libre en la forma de expresarnos es un derecho primordial que se reconoce a todo ser
humano, y por medio de ella la persona puede expresarse con toda libertad cuando
piensa.; sin embargo, su práctica debe realizarse sin mancillar otros derechos
primordiales, como puede ser la suposición a ser inocente por la cual nadie es considerado
culpable mientras no se le pruebe en un debido proceso. El objetivo de esta investigación
ha sido analizar el modo en que los abusos de expresarse libremente en los medios de
comunicación social en nuestro país afectan al principio de presunción de inocencia. El
enfoque metodológico ha sido cualitativo documental del tipo dogmático exploratorio.
En los resultados se han presentado casos mediáticos que han significado la afectación
de la suposición a ser inocente por un ejercicio incorrecto de expresarse libremente en los
medios de comunicación nacional y local. Así mismo mediante el análisis de la
jurisprudencia y de las convenciones internacionales se ha precisado los criterios que
deben tenerse en cuenta al ejercitar la libertad a poder expresarse en los medios de
comunicación. La investigación constituye un aporte a la discusión jurídica sobre el tema
que resulta sensible pues se halla en las fronteras de la libertad y la desaprobación que
eventualmente puedan imponer gobiernos dictatoriales; sin embargo, al estar en juego la
presunción de inocencia, se hizo necesario el presente análisis para salvaguardar este
principio tan importante para una convivencia social respetuosa de la persona humana y
de su honor y buen nombre.
Being free in the way we express ourselves is a primordial right that is recognized to every human being, and by means of it the person can express himself freely when hethinks; however, its practice must be carried out without sullying other primordial rights, such as the presumption of innocence by which no one is considered guilty until proven in a due process. The objective of this research has been to analyze the way in which the abuses of free speech in the social media in Peru affect the principle of presumption of innocence. The methodological approach has been qualitative documentary of the exploratory dogmatic type. In the results, media cases have been presented that have meant the affectation of the presumption of innocence by an incorrect exercise of expressing oneself freely in the national and local media. Likewise, through the analysis of jurisprudence and international conventions, the criteria that must be taken into account when exercising the freedom to express oneself in the media have been specified. The research constitutes a contribution to the legal discussion on this sensitive subject, since it is on the frontiers of freedom and the disapproval that may eventually be imposed by dictatorial governments; however, since the presumption of innocence is at stake, this analysis was necessary to safeguard this important principle for a social coexistence respectful of the human person and his or her honor and good name.
