El límite del tipo penal de estelionato y la venta del bien litigioso

Abstract

La tesis realiza un estudio analítico de las figuras del estelionato y de la venta de bien litigioso, por considerarlas contradictorias, toda vez que por un lado se permite la venta de bienes litigiosos conforme a las normas del Código Civil, y por otro se sanciona ésta, al ser considerada un delito. Finalmente, propone la modificatoria del artículo 197, inciso 4 del Código Penal, de manera que se termine con dicha contradicción y se evite generar inseguridad jurídica.

The thesis makes an analytical study of the crime of stellionate and the sale of litigious property, considering them contradictory, since on the one hand the Civil Code allows the sale of litigious property and in the other hand, it is considered a crime. Finally, the thesis proposes the amendment of article 197, paragraph 4 of the Criminal Code, as a way of ending this contradiction and avoiding the generation of legal insecurity.
