Motivación de resoluciones que otorga medidas de protección emitidas por los juzgados de familia de Tambopata del distrito judicial de Madre de Dios, 2019-2020

Abstract

Señor DECANO de la facultad de derecho de la Universidad Andina del Cusco. En función a lo dispuesto en la Ley N° 30220, el Estatuto de la UAC y el Reglamento de Grados y Títulos de la “Universidad Andina del Cusco”, pongo a vuestra distinguida consideración la tesis intitulada “MOTIVACION DE RESOLUCIONES QUE OTORGA MEDIDAS DE PROTECCION EMITIDAS POR LOS JUZGADOS DE FAMILIA DE TAMBOPATA DEL DISTRITO JUDICIAL DE MADRE DE DIOS, 2019-2020”; con el propósito de optar al título profesional de Abogado. La misma que refleja en esencia la motivación emitida por el operador justicia en la resolución en el marco de la Ley 30364, cuyo sistema no funciona adecuadamente en nuestra actualidad, donde cabe mencionar que una de las causas es la motivación de las resoluciones judiciales. La exploración de esta problemática se realizó por el interés de conocer en profundidad el contenido de las resoluciones en materia de violencia familiar, además nos permitió determinar qué medidas de patrocinio se dan a las de sexo femenino frente a la violencia familiar, y si estas están debidamente motivadas, así mismo el investigador ha podido advertir que los jueces otorgan medidas de auxilio a casos muy ajenos de configurar maltrato familiar; cabe precisar además que la mayoría de las resoluciones emitidas por la Sala Civil de Madre de Dios son declaradas nula, a razón de motivación insuficiente.

Actualmente existe un índice muy alto en los problemas que se presentan en “MOTIVACION DE RESOLUCIONES QUE OTORGA MEDIDAS DE PROTECCION EMITIDAS POR LOS JUZGADOS DE FAMILIA DE TAMBOPATA DEL DISTRITO JUDICIAL DE MADRE DE DIOS, 2019-2020”. Ante la existencia de esta problemática se realizó el presente estudio referido al estudio de esta variable de estudio, y sus dimensiones; las mismas que se ponen a vuestra consideración.

The investigation of this problem was corried out in the interest of knowing in depth the content of the resolutions on family violence, it also allowed us to identify what protection measures are given to women against family violence, and if they are duly motivated Likewise, the researcher has been able to warn that the judges grant protection measures to cases very unrelated to configuring family violence; it should also be noted that most of the resolutions issued by the Civil Chamber of Madre de Dios are declared null, due to insufficient reasons.
