Las medidas de protección y los tipos de violencia familiar dentro del contexto del Covid-19, tramitadas en el juzgado mixto de Echarate de la provincia de La Convención durante el periodo marzo 2020 a marzo del 2021

Abstract

En esta tesis titulada: “LAS MEDIDAS DE PROTECCIÓN Y LOS TIPOS DE VIOLENCIA FAMILIAR DENTRO DEL CONTEXTO DEL COVID-19, TRAMITADAS EN EL JUZGADO MIXTO DE ECHARATE DE LA PROVINCIA DE LA CONVENCIÓN DURANTE EL PERIODO MARZO 2020 A MARZO DEL 2021”, investigación del cual se prevé que en la actualidad las medidas de protección y los tipos de violencia familiar en el contexto del Covid-19 tramitadas en el Juzgado Mixto de Echarate son ineficaces. Por otro lado, se tiene que las medidas de protección tramitadas en el Juzgado Mixto de Echarate aparte de ser ineficaces son ineficientes, teniendo como principales tipos de violencia: Violencia física, violencia psicológica, violencia sexual y la violencia económica. Para lo cual se desarrolló un estudio cualitativo, no experimental y descriptivo y con una tipología básica, donde tuvimos como universo de estudio 454 expedientes tramitados en el Juzgado Mixto de Echarate en el periodo marzo 2020 a marzo 2021, donde finalmente 25 expedientes conformaron la muestra, recolectando datos mediante la técnica del análisis de expediente y teniendo como instrumento la ficha de análisis documentario. De los resultados obtenidos se concluye que, se aplicaron las siguientes medidas de protección: Ausencia de cualquier tipo de maltrato físico, psicológico o sexual, prohibición de acoso, orden de alejamiento, en determinadas situaciones se restringió el acercamiento a menos de 100 metros del sujeto, acompañamiento policial y en algunas circunstancias se dio la medida de protección con la intervención de una terapia psicológica tanto para el demandante como para el acusado; a su vez se encontraron los siguientes tipos de violencia familiar: violencia corporal y psíquica, pero en algunos casos también hubo indicios de violencia económico o patrimonial, que no se incluyeron en el juicio oral al no existir coartadas claras.

In this thesis entitled: "THE PROTECTION MEASURES AND TYPES OF FAMILY VIOLENCE WITHIN THE CONTEXT OF COVID-19, PROCESSED IN THE MIXED COURT OF ECHARATE OF THE PROVINCE OF LA CONVENTION DURING THE PERIOD MARCH 2020 TO MARCH 2021", research from which it is predicted that at present the protection measures and types of family violence in the context of Covid-19 processed in the Mixed Court of Echarate are ineffective. On the other hand, the protection measures processed in the Mixed Court of Echarate are ineffective and inefficient, with the main types of violence being: physical violence, psychological violence, sexual violence and economic violence. For which a qualitative, non-experimental and descriptive study was developed with a basic typology, where we had as a study universe 455 files processed in the Mixed Court of Echarate in the period March 2020 to March 2021, where finally 25 files made up the sample, collecting data through the technique of file analysis and having as an instrument the documentary analysis form. From the results obtained it is concluded that, the following protection measures were applied: absence of any type of physical, psychological or sexual abuse, prohibition of harassment, restraining order, in certain situations the approach was restricted to less than 100 meters from the subject, police accompaniment and in some circumstances the protection measure was given with the intervention of psychological therapy for both the plaintiff and the defendant; in turn the following types of family violence were found: corporal and psychic violence, but in some cases there were also indications of economic or patrimonial violence, which were not included in the oral trial as there were no clear alibis.
