Medidas de protección a menores de edad víctimas del delito de violación sexual en los juzgados penales del distrito judicial de Cusco, 2020-2021

Abstract

El presente trabajo titulado “Medidas de Protección a Menores de Edad Víctimas del Delito de Violación Sexual en los Juzgados Penales del Distrito Judicial de Cusco, 20202021”, se centra en el análisis de las medidas de protección dictadas a las víctimas menores

de 14 años del delito de violación sexual, según lo establecido en el artículo 173 del Código

Penal.

El objetivo principal de esta tesis es identificar en las sentencias condenatorias las medidas de protección que se conceden a los menores que han sido víctimas del delito en mención y como el Estado a través de estas medidas garantiza su bienestar físico como psicológico de los niños y niñas de nuestro país. Se utilizó un enfoque cualitativo que incluyó un análisis de 5 casos judiciales sobre el delito en mención, incluyendo entrevistas a diferentes operadores del derecho como jueces, fiscales, abogados defensores y psicólogos. Los resultados de este estudio se centran en las medidas de protección proporcionadas a los menores de 14 años que han sido víctimas de violencia sexual. Estas medidas son valiosas, pero su eficacia puede variar de manera significativa debido a la falta de personalización según las circunstancias individuales de cada caso. A pesar de que estas medidas son emitidas por el Juzgado de Familia, es fundamental que el juez penal también refuerce estas medidas en su sentencia final. Este estudio contribuye a la comprensión sobre de las medidas de protección en beneficio de las víctimas menores de 14 años de violencia sexual tanto antes, durante y después del proceso penal, destacando la importancia de un correcto monitoreo de las medidas otorgadas por el sistema judicial, de esta manera proteger la integridad sexual de los menores de edad. Las medidas de protección son herramientas esenciales para cesar la violencia sexual pero su efectividad dependerá de una correcta implementación de acuerdo a las necesidades las víctimas.

This work entitled “Protection Measures for Minor Victims of the Crime of Sexual Rape in the Criminal Courts of the Judicial District of Cusco, 2020-2021”, focuses on the analysis of the protection measures dictated to victims under 14 years of the crime of rape, as established in article 173 of the Penal Code. These measures are valuable, but their effectiveness can vary significantly due to a lack of customization to the individual circumstances of each case. Although these measures are issued by the family court, it is essential that the criminal judge also reinforces these measures in his final sentence. This study contributes to the understanding of protection measures for the benefit of victims under 14 years of sexual violence both before, during and after the criminal process, highlighting the importance of correct monitoring of the measures granted by the judicial system. in this way protect the sexual integrity of minors. Protective measures are essential tools to stop sexual violence, but their effectiveness will depend on correct implementation according to the needs of the victims.
