Abstract: La presente investigación trata de un “Estudio comparativo de privación de
nacionalidad en Perú y Francia”. El objetivo general fue: Comprender porque se
privó en el país del título de nacionalidad a un israelí naturalizado peruano y la
necegación a un peruano de la petición de nacionalidad francesa, como se
solucionó cada caso y cuáles fueron las consecuencias. El tipo de investigación
fue cualitativo, la investigación jurídica fue un estudio de casos. La técnica que se
utilizó fue el análisis de documentos jurídicos. Se concluyo, entre otros: que el
Gobierno peruano privó del título de nacionalidad a Baruch Ivcher en represalia
por haberse difundido en el canal de televisión de su propiedad delitos de torturas
y otros. El caso se resuelve en la CIDH con una reparación. El Ministerio del
Interior de Nueva Caledonia rechazó la petición de una solicitud de nacionalidad
francesa a un ciudadano peruano, simplemente por la denuncia de su ex-pareja por
violencia sin considerar todas las circunstancias y resolución anterior del
conflicto. El proceso se resolvió después de un poco más de seis años a favor del
interesado. A diferencia del caso del ciudadano israelí en el Perú, se resolvió de
acuerdo a la legislación interna de Francia y se le abonó un monto mínimo en
relación al caso ocurrido en Perú.
This research is about a “Comparative study of denial of nationality in Peru and France”. The general objective was: To understand why a peruvian citizenship of an Israeli a person was revoked, and access to French citizenship was denied to a peruvian person, how each case was solved and what the consequences were. The type of research was qualitative, the legal research was a case study. The technique used was the analysis of legal documents. It was concluded, among others: that the Peruvian Government deprived Baruch Ivcher of his nationality title in retaliation for having reported on the television channel of his property crimes of torture and others. The case is resolved at the IACHR with reparation. The Ministry of the Interior of New Caledonia rejected the request for an application for French nationality to a peruvian citizen, simply because of the complaint of his ex-partner for his violence without considering all the circumstances and previous resolution of the conflict. The process was resolved after a little more than six years in favor of the interested party. Unlike the case of the Israeli citizen in Peru, it was resolved in accordance with the internal legislation of France and a minimum amount was paid in relation to the case that occurred in Peru.
