Abstract: El derecho de Reivindicación, según la doctrina Civil, es el atentado contra el
derecho a la propiedad, pues constituye un derecho Real que el Código Civil
Peruano, regula en su artículo 927°,de la norma sustancial antes precisada, ya
que el derecho de propiedad se encuentra regulada por la norma Civil, cuando
una persona no propietaria posee un bien inmueble que no es el legítimo dueño
del bien, en tal sentido la norma prevé; “la acción Reivindicadora es
imprescriptible y no procede con el que adquirió el bien por prescripción“.
asimismo en sus artículo 979°, del Código Civil, en donde da a conocer la
Reivindicación y Defensa del Bien común, en que a la letra menciona; la acción
reivindicadora lo puede interponme cualquiera de los copropietarios de un bien
inmueble, se entiende que el posesionario no es propietario del bien en
materia de Litis.

Likewise in its article 979 °, of the Civil Code, where it makes known the Claim and Defense of the Common Good, in which the letter says; the claiming action can be filed by any of the co-owners of a real estate property, it is understood that the possessor does not own the property subject of litigation.
