Cumplimiento de las obligaciones laborales del régimen de construcción civil – caso Perú Proyect Chilloroya S.A. de la provincia de Chumbivilcas-Cusco periodo 2018

Abstract

El trabajo de investigación intitulado “CUMPLIMIENTO DE LAS OBLIGACIONES LABORALES DEL RÉGIMEN DE CONSTRUCCIÓN CIVIL- CASO PERÚ PROYECT CHILLOROYA S.A. DE LA PROVINCIA DE CHUMBIVILCAS- CUSCO PERIODO 2018, está enfocado en el sector de construcción civil, sector en el cual existe omisión en el cumplimiento de las obligaciones laborales, toda vez que, las empresas no registran a sus trabajadores en planilla para no pagar las remuneraciones y beneficios sociales acorde al Régimen de Construcción Civil; y los trabajadores, no exigen el cumplimiento de sus derechos por desconocimiento, por no querer asumir descuentos a su remuneración, miedo a represalias de no volver a ser contratados, entre otros motivos.. El objetivo de la presente investigación, es evaluar el nivel de cumplimiento de las obligaciones laborales del Régimen de Construcción Civil en la empresa Perú Proyect Chilloroya S.A de la provincia de Chumbivilcas – Cusco en el periodo 2018. La hipótesis planteada al problema de investigación es que el cumplimiento de las obligaciones laborales del Régimen de Construcción Civil – Caso Perú Proyect Chilloroya S.A de la provincia de Chumbivilcas - Cusco, periodo 2018 es mínimo. La metodología utilizada en la presente investigación, es de tipo básica, enfoque cuantitativo, diseño no experimental y alcance descriptivo, el tamaño y muestra de la población está conformada por el Gerente (01), Subgerente (01), Directorio (05), Administradores (02) y Contador (01) de la empresa Perú Proyect Chilloroya S.A. durante el periodo 2018. Las técnicas de recolección de datos han sido el análisis documental y la encuesta. El estudio consta de cinco capítulos: El capítulo I Introducción está conformado por el planteamiento y formulación del problema, objetivos, justificación y delimitación de la investigación. El Capítulo II Marco Teórico, está conformado por los antecedentes de investigación, bases legales, bases teóricas, caso práctico, marco conceptual, formulación de la hipótesis y variables de estudio. El capítulo III Método de Investigación que contiene el tipo, enfoque, diseño y alcance de la investigación, población y muestra, técnicas e instrumentos de recolección de datos y procesamiento de datos. El capítulo IV Resultados de la Investigación que contiene las tablas y sus interpretaciones. El capítulo V Discusión de los Resultados conformado por descripción de los hallazgos más relevantes y significativos, limitaciones de estudio, comparación crítica con la literatura existente e implicancias de estudio. Finalmente, la conclusión a la cual se arribó en base a los resultados obtenidos, es que el nivel de cumplimiento de las obligaciones laborales formales y sustanciales del Régimen de Construcción Civil – Caso Perú Proyect Chilloroya S.A de la provincia de Chumbivilcas - Cusco, periodo 2018 es mínimo, situación que conlleva a que la empresa incurra en infracciones, sanciones y multas.

The research work entitled “COMPLIANCE WITH LABOR OBLIGATIONS OF THE CIVIL CONSTRUCTION REGIME- CASO PERÚ PROYECT CHILLOROYA S.A. OF THE PROVINCE OF CHUMBIVILCAS- CUSCO PERIOD 2018, is focused on the civil construction sector, specifically in the company Peru Project Chilloroya, a sector in which there is omission in the fulfillment of labor obligations, since companies do not register its workers on the payroll for not paying salaries and social benefits according to the Civil Construction Regime; and the workers do not demand compliance with their rights due to ignorance, not wanting to take discounts on their remuneration, fear of reprisals for not being hired again, among other reasons. The objective of this investigation is to assess the level of compliance with the labor obligations of the Civil Construction Regime in the company Perú Proyect Chilloroya SA of the province of Chumbivilcas - Cusco in the period 2018. The hypothesis raised to the research problem is that the fulfillment of the labor obligations of the Civil Construction Regime - Case of Peru Project Chilloroya SA of the province of Chumbivilcas - Cusco, 2018 period is minimal. The methodology used in this research is of a basic type, quantitative approach, non- experimental design and descriptive scope, the size and sample of the population is made up of the Manager (01), Assistant Manager (01), Board of Directors (05), Administrators (02) and Accountant (01) of the company Perú Proyect Chilloroya SA during the 2018 period. The data collection techniques have been the documentary analysis and the survey. The study consists of five chapters: Chapter I Introduction is made up of the statement and formulation of the problem, objectives, justification and delimitation of the research. Chapter II Theoretical Framework is made up of the research background, legal bases, theoretical bases, practical case, conceptual framework, formulation of the hypothesis and study variables. Chapter III Research Method contains the type, focus, design and scope of the research, population and sample, techniques and instruments for data collection and data processing. Chapter IV Research Results containing the tables and their interpretations. Chapter V Discussion of the Results consists of a description of the most relevant and significant findings, study limitations, critical comparison with the existing literature and study implications. Finally, the conclusion reached based on the results obtained is that the level of compliance with the formal and substantial labor obligations of the Civil Construction Regime - Peru Project Chilloroya SA Case of the province of Chumbivilcas - Cusco, period 2018 it is minimal, a situation that leads the company to incur infractions, penalties and fines.
