Abstract: El presente trabajo de investigación titulado “Trabajo Infantil y la Vulneración de los
Derechos Del Niño en el Comercio Ambulatorio del Cercado del Cusco, 2022”, tuvo como
objetivo general determinar cómo se vulneran los derechos del niño en relación al trabajo
infantil desarrollado en el comercio ambulatorio, en vista del incremento del problema
existente con relación al trabajo infantil en la Ciudad. En el aspecto metodológico, se trata
de un enfoque cualitativo, de diseño socio jurídico. La investigación se desarrolló en el
Distrito del Cusco, que comprende la zona histórica como es la plaza de armas del Cusco y
las calles aledañas. Se hizo uso de las técnicas de la entrevista y el análisis documental. De
la guía de entrevista semi estructurada como instrumento, en el caso del análisis documental,
se hizo uso de la ficha de recojo de datos como instrumento. Concluyendo que la vulneración
de los derechos del niño en el trabajo infantil desarrollado en el comercio ambulatorio tiene
como causa la ineficacia de la legislación nacional e internacional existente en nuestro país
que se ve reflejado en el rol deficiente que ejerce el Estado en cuanto a hacer seguimiento
del ejercicio pleno de los derechos de los niños.
The present research work entitled "Child Labor and the Violation of Children's Rights in the Ambulatory Commerce of the Cercado del Cusco, 2022", had the general objective of determining how children's rights are violated in relation to child labor developed in the ambulatory commerce, in view of the increase of the existing problem in relation to child labor in the City. In the methodological aspect, it is a qualitative approach, with a socio- legal design. The research was carried out in the District of Cusco, which includes the historical area such as the main square of Cusco and the surrounding streets. Interview and documentary analysis techniques were used. The semi-structured interview guide was used as an instrument, and in the case of documentary analysis, the data collection form was used as an instrument. The conclusion is that the violation of children's rights in child labor in street commerce is caused by the ineffectiveness of national and international legislation in our country, which is reflected in the deficient role played by the State in monitoring the full exercise of children's rights.
