The application of the principle of opportunity to cases of driving under the influence of alcohol is a common practice, as it is considered a less severe offense. However, this situation has different effects when the offense is committed during a state of emergency. For this reason, the objective of this research is to determine whether the application of the principle of opportunity to offenses of driving under the influence of alcohol prevents the preventive purpose of the penalty during the COVID-19 state of emergency in the Third Provincial Corporate Criminal Prosecutor's Office of Cusco, years 2020-2021. In this sense, we followed a quantitative approach with a non-experimental design and descriptive scope to conduct a survey of the 16 members of the Third Provincial Corporate Criminal Prosecutor's Office of Cusco regarding the application of the principle of opportunity for cases of driving under the influence of alcohol and the preventive purpose of the penalty. The survey results indicate that the application of the principle of opportunity does not prevent the fulfillment of the preventive purpose of the penalty and, on the contrary, there was a reduction in the commission of the offense of driving under the influence of alcohol. However, the same individuals committed the offense up to a second time during the COVID-19 state of emergency. In light of these results, the evaluation of the current regulations is recommended to control the effects of the repeated application of the principle of opportunity, mainly when the offense occurs during a state of emergency.
