The present investigation, "THE EARLY CONCLUSION IN LAW 30838 AND THE RIGHT TO EQUALITY BEFORE THE LAW IN THE PROCESSES OF THE CRIME OF SEXUAL RAPE IN THE PROCEDURAL ACTIVITY IN THE JUDICIAL DISTRICT OF CUSCO SEDE SICUANI." Its objective was to analyze whether the application of article 5 of Law 30838 violates the constitutional right to equality before the law in the judicial district of Cusco Sicuani headquarters in 2019; For this, it is clear whether the application of article 5 of law 30838 in the crimes of rape is discriminatory with respect to other crimes of greater criminal relevance and an analysis of proportionality and reasonableness of article 5 of law 30838 was applied. For this, a basic study was used, the research approach was qualitative. The technique used to contract hypotheses was file analysis and documentary analysis. The results concluded that article 5 of Law 30838, referring to the prohibition of early conclusion in the crimes of rape, violate the right to equality and non-discrimination of those accused of the crime of rape. In addition to going against the principle of legality, proportionality of the sentence, penalty fines and due process; and that, the application of the early conclusion for the crimes of sexual violation, when having high penalties, does not contravene against the constitutional fines of the penalty.
