La cámara Gesell como prueba anticipada en delitos de trata de personas tramitados en la fiscalía provincial especializada contra la criminalidad organizada de Andahuaylas del año 2020 al 2021

Abstract

El derecho a la dignidad humana y el derecho a la libertad son parte integrante de los derechos constitucionales, fundamentales y humanos de todas las personas, cuya vulneración es reprimida por varios delitos, en la presente investigación trataremos el delito de Trata de Personas, tipificado en el art. 192°-A de nuestro ordenamiento penal, cuyo verbo rector radica en captar a una futura víctima, ganarse su confianza, y posteriormente utilizar la violencia para someterla a cualquiera de los diferentes tipos de explotación como son: tráfico de órganos, explotación sexual, trabajos forzados, , venta de niños, etc. para obtener un beneficio lucrativo. En los últimos años este delito se ha ido incrementando en nuestra sociedad y los responsables o agresores que cometen este tipo de delitos quedan en libertad. Realizando un análisis de esta situación pudimos observar que el instrumento principal que demuestra la veracidad de los hechos y puede coadyuvar a resolver la culpabilidad del acusado no está siendo utilizada de la forma que corresponde; nos referimos a “La Cámara Gesell”, puesto que el sistema de justicia no realiza las diligencias en el tiempo idóneo, es así que el testimonio de la víctima termina siendo alterado y a su vez la víctima sufre la revictimización lo que dificulta el hecho de recuperarse completamente de los hechos sucedidos y reinsertarse nuevamente en la sociedad. Nuestra investigación tiene por finalidad hacer dar cuenta de la necesidad urgente e inmediata de la aplicación de la diligencia de cámara Gesell para las víctimas resultantes del delito de Trata de personas, para proteger su declaración primigenia y evitar su revictimización. Para finalizar podemos decir que nuestra investigación cuenta con argumentación tanto jurídica como social.

The rights to human dignity and freedom are fundamental and international rights of all people, which are repressed for various crimes, but the one that we will deal with in our investigation is "Trafficking in Persons", contemplated in art. 192-A of the penal code, which consists of capturing a future victim, gaining her trust, and later using violence to subject her to any of the different types of exploitation such as: sexual exploitation, forced labor, organ trafficking, sale of boys and girls for the purpose of making a lucrative profit. In recent years this crime has been increasing in our society and those responsible or aggressors who commit this type of crime are released. Carrying out an analysis of this situation, we were able to observe that the main instrument that demonstrates the veracity of the facts and can help to resolve the defendant's guilt is not being used in the appropriate way; we refer to "The Gesell Chamber", since the justice system does not carry out the proceedings in the appropriate time, so the victim's testimony ends up being altered and in turn the victim suffers re-victimization, which makes it difficult to recover completely from the events that took place and reintegrate back into society. The purpose of our research is to account for the urgent and immediate need for the application of the Gesell camera in the victims of the crime of Trafficking in Persons, to protect their original statement and avoid their re-victimization. To conclude, we can say that our research has both legal and social arguments.
