In the face of the failure to provide for their children, many parents have been sued for the judge to order them to pay alimony, which will apply as long as the beneficiary is a minor (CC, 1984, article 418°). Exceptionally, this obligation will continue if the child’s state of need remains due to physical or mental incapacity, or if he or she successfully studies a profession or profession, in this case up to the age of 28 (CC, 1984, Articles 483° and 424°). Given that, in the Peruvian State, there are in fact many cases of exoneration of food, where the claims have been declared inadmissible because the obligor is not up to date in the payment of maintenance and in other cases the obligor has had to pay maintenance beyond the established deadlines, We believe that the process of exempting food should be made more flexible. In order to correct situations of violation of the right to effective judicial protection and the principles of speedy procedural economy, Article 483° of the Civil Code and Article 565-A of the Code of Civil Procedure must be amended.
