The thesis focuses on analyzing Law No. 31298, which prohibits public entities from hiring personnel through the contracting of services for activities of a subordinate nature, highlighting the need for adequate regulation to guarantee compliance and avoid the denaturalization of contracts. • Objectives: Describe the legal importance of the regulations of Law No. 31298. Identify the causes and legal effects of the lack of regulation of said law. • Hypothesis: The lack of regulation encourages the persistence of contracting under the modality of outsourcing of services, concealing labor relations. Possibly, there are deficiencies in the execution of regulatory power and partisan political interests that contribute to the lack of regulation. • Methodology: Analysis of judicial sentences and interviews with six experts were carried out, corroborating the proposed hypotheses and achieving the research objectives. • Background Analysis: Three previous theses that address related topics were reviewed, finding similarities and differences in the conclusions regarding the denaturalization of contracts, non-compliance with legal regulations and the violation of labor rights. • Comparative Analysis: The corroboration of the hypotheses and the fulfillment of the research objectives were highlighted, evidencing the need for adequate regulations for Law No. 31298. • Conclusions: Law No. 31298 requires adequate regulation to avoid the denaturalization of contracts and guarantee labor rights. The findings support the hypotheses and meet the proposed objectives, highlighting the importance of regulation and supervision in public procurement. • Recommendations: Prepare clear regulations for Law No. 31298. Establish supervision and control mechanisms to guarantee the correct application of the law. Carry out periodic audits of service rental contracts in public entities. • Regulatory Proposal: A draft regulation was proposed for Law No. 31298, which includes the holding of public tenders for the hiring of personnel, responsibilities of officials in the call, supervision by SERVIR, and audit by the Comptroller's Office of the Republic. The thesis provides a detailed analysis of the need and implications of adequately regulating Law No. 31298, proposing a draft regulation as a solution to the problems identified in the hiring of personnel in public entities.
