This research work is aimed at contributing to the effective restitution of the right to live in a family of children and adolescents, who are involved in a Tutelary Investigation procedure, by virtue of the fulfillment of Article 4 of the Political Constitution of Peru and the commitment adopted by our State in the ratification of the Convention on the Rights of the Child in 1990. Likewise, in the present research work we will confirm the necessary deconcentration of the governing entity in tutelary matters (Ministry of Women and Vulnerable Populations), it will be corroborated that the Judicial Power is not the ideal organ to know the tutelary processes. The present investigation is divided into the following chapters: The first, referring to the research problem, where we identify the problem, the formulation of the problem, define the objectives, the justification, as well as the methodology and hypothesis of the study. The second, chapter in which the theoretical and conceptual analysis of research is developed, developing extensively that refers to the procedure of Tutelary Research. The third, the results and the corresponding analysis are developed, specifically of the documentary collection and the interviews made to the different professionals who know the subject. In addition, the respective conclusions, recommendations and bibliography are also available.
