The present work is entitled "Lack of identification of perpetrators of the crime of theft as a consequence of a deficient investigation of the Public Prosecutor's Office in the prosecutorial district of Cusco, province of Cusco in 2019" and its objective was to observe the deficient investigation of the Public Prosecutor's Office regarding the identification of the perpetrator in the crime of theft in Cusco in 2019. Therefore, it covered the analysis of the crimes against patrimony, with respect to the crime of theft contemplated in the Criminal Code, as well as the legal elements to configure such crime. Therefore, the principle of legality is important, since every exercise must be carried out in accordance with the law in force. Peruvian society feels insecure in the streets where they travel because there are no police officers or the security cameras to be able to identify the perpetrators are insufficient, if a crime against patrimony is perpetrated, which could be theft or robbery, in this way Peruvians believe that the Public Ministry, the National Police of Peru, the Regional Governments and the municipalities of each district are to blame for all of this. As they observe the increase of all these crimes year after year at the national level. The Cusco Region is no stranger to this type of crime, the scarcity or simply the non-existence of video surveillance cameras in the streets of high insecurity makes it difficult to recognize the accused when collecting information and evidence to identify them and give them the corresponding penalties. Having a very high crime rate, it is known to the population that the crime of theft has grown abysmally in recent years, one of the most frequent thefts being the theft of cell phones, wallets and other personal property, as well as the growth of aggravated theft.
