Falta de identificación de autores del delito de hurto como consecuencia de una deficiente investigación del Ministerio Público en el distrito fiscal del Cusco, provincia del Cusco en el año 2019

Abstract

El presente trabajo lleva como título “Falta de identificación de autores del delito de hurto como consecuencia de una deficiente investigación del Ministerio Público en el distrito fiscal del Cusco, provincia del Cusco en el año 2019.” y tuvo como objetivo observar la deficiente investigación del Ministerio Público para lograr la identificación del autor en el delito de hurto en la provincia del Cusco en el año 2019. La investigación abarcó analizar los delitos Contra el patrimonio, en específico el delito hurto contemplado en el Código Penal, como también analizar los elementos jurídicos para que se configure tal delito. Por ello, es importante el principio de legalidad, ya que todo ejercicio debe de realizarse de acuerdo con la ley en vigencia. La sociedad peruana se siente insegura en las calles por donde transitan porque no hay efectivos policiales o las cámaras de seguridad suficientes, pues si se perpetraría un delito Contra el Patrimonio, que puede ser el hurto o robo, no se podría identificar a los autores, de esta forma los peruanos creen que la culpa de todo ello la tiene el Ministerio público, la Policía Nacional del Perú, los Gobiernos Regionales y/o los municipios de cada distrito. Por lo que observan en el incremento de todos estos delitos año a año a nivel nacional. La Región del Cusco no es ajena a este tipo de delitos, los escases o simplemente la inexistencia de cámaras de video vigilancia en las calles de alta inseguridad dificultan el reconocimiento de los imputados a la hora de recopilar información y pruebas para poder identificarlos y darles las penas correspondientes. Teniendo un indicie delincuencial muy elevado, es de conocimiento de la población que el delito de hurto creció en estos últimos años abismalmente, siendo uno de los hurtos más frecuentes el hurto de celulares, de carteras, y otros bienes muebles de igual forma es el crecimiento del delito de hurto agravado.

The present work is entitled "Lack of identification of perpetrators of the crime of theft as a consequence of a deficient investigation of the Public Prosecutor's Office in the prosecutorial district of Cusco, province of Cusco in 2019" and its objective was to observe the deficient investigation of the Public Prosecutor's Office regarding the identification of the perpetrator in the crime of theft in Cusco in 2019. Therefore, it covered the analysis of the crimes against patrimony, with respect to the crime of theft contemplated in the Criminal Code, as well as the legal elements to configure such crime. Therefore, the principle of legality is important, since every exercise must be carried out in accordance with the law in force. Peruvian society feels insecure in the streets where they travel because there are no police officers or the security cameras to be able to identify the perpetrators are insufficient, if a crime against patrimony is perpetrated, which could be theft or robbery, in this way Peruvians believe that the Public Ministry, the National Police of Peru, the Regional Governments and the municipalities of each district are to blame for all of this. As they observe the increase of all these crimes year after year at the national level. The Cusco Region is no stranger to this type of crime, the scarcity or simply the non-existence of video surveillance cameras in the streets of high insecurity makes it difficult to recognize the accused when collecting information and evidence to identify them and give them the corresponding penalties. Having a very high crime rate, it is known to the population that the crime of theft has grown abysmally in recent years, one of the most frequent thefts being the theft of cell phones, wallets and other personal property, as well as the growth of aggravated theft.
